Terms of use
About these terms
These terms apply when you use the Tortally app, this website, and showcase pages. The service is provided by Igor Soldatov, an individual (“we”). By using Tortally you agree to these terms. If you do not agree, please do not use it.
You must be at least 18 years old to use Tortally. Questions: [email protected].
What Tortally does
Tortally helps you work out what a cake costs and what to charge. It calculates prices from the quantities, prices, time and margin that you enter. Check those numbers before you quote a customer.
The results are arithmetic, not advice. Tortally does not give tax, legal, accounting, food-safety, or allergen advice, and it does not guarantee that you will earn money. You are responsible for your prices, your ingredient labels, allergen information, compliance with local cottage-food and business rules, and your taxes.
A saved quote keeps its original calculation. Updating ingredient package prices changes the costs calculated for current recipes, but not saved quotes. Your recipes live on your phone, so keep an external backup before you delete or reinstall the app.
Free features and purchases
Cost calculation, recipes, quotes and exports are free. The free version shows ads.
- Remove ads is a one-time purchase of $3.99 that turns ads off for good. It does not include Pro features and its price is not credited toward Pro.
- Pro costs $4.99 per month or $29.99 per year. The annual plan is billed in full once a year. Both plans let you publish one showcase with up to 12 cake listings and receive customer requests. Ads are off while Pro is active.
Prices listed here are in US dollars. Your app store shows the price in your local currency and any applicable taxes before you buy.
Subscriptions and free trial
Pro is an auto-renewing subscription sold through the Apple App Store or Google Play. New Pro subscribers get a 14-day free trial when the store offers it to them. The store shows the trial length, the price after the trial, and the date of the first charge before you confirm. Trial eligibility and any limits on repeat trials are determined by the store.
Your subscription renews automatically at the end of each period until you cancel. To avoid a charge, cancel at least 24 hours before the trial or the current period ends. To cancel:
- on iPhone, open Settings, tap your name, then Subscriptions, choose Tortally, and follow the steps to cancel;
- on Android, open Google Play, tap your profile, then Payments & subscriptions, then Subscriptions, choose Tortally, and follow the steps to cancel.
If you cancel, Pro stays active until the end of the period you already paid for (or the end of the trial). Deleting the app or your account does not cancel a subscription.
Refunds are handled by Apple or Google under their own rules, not by us. On Apple, use Apple’s Report a Problem page. On Google Play, use the order history in Google Play. If you cannot get help there, write to us and we will help you find the right path.
When Pro ends, your showcase goes offline and customers can no longer send you new requests. Requests you already received stay available to you for up to 90 days unless deleted earlier. Your local recipes and quotes are not affected. You can restore past purchases in the app on the same store account.
Showcases and customer requests
A showcase is a public page where you list cakes and take requests from customers. To publish one you need an account, an internet connection and an active Pro subscription. Before a new or changed showcase goes live, it is checked, which can take some time.
A request is not an order. The confirmation a customer gets after submitting a request only confirms that the request was sent. The baker decides whether to accept it. Customers and bakers discuss availability and allergen information and agree on the final price, delivery, and payment directly. Tortally does not collect payment for cakes, takes no commission, and is not a party to the sale. We are not responsible for the quality, safety or delivery of any cake, or for transactions or disputes between a baker and a customer.
Customers do not pay to send a request.
Rules for showcases
You are responsible for everything you publish. You may only publish content that is accurate, that you own or have permission to use, and that follows the law. You must not publish:
- false or misleading claims, including fake prices, fake reviews, or health or allergen claims you cannot support;
- photos or text you do not have the right to use, or that identify someone without their consent;
- listings for illegal goods or services, or for anything other than cakes and related baked goods;
- sexual, hateful, violent or harassing content, or content that targets children;
- spam, scams, links to harmful sites, or personal data of other people;
- a showcase name or address that copies another baker’s or business’s name or address, or impersonates Tortally or its support team.
Showcase addresses cannot be sold or traded, and a name that was once published is not given to anyone else.
Reports and removal
Anyone can report a showcase from its page, without an account. We review the reports we receive. If content appears harmful or unlawful, or seems to violate these rules, we may hide it right away while we investigate, then remove a listing or a whole showcase, or close the account if the problem is serious or repeated. A report on its own does not prove a violation, and we may ask the baker for details or give them a chance to reply.
Visitors can also hide a baker in their own browser. If you think we made a mistake, write to [email protected] with your showcase address and we will look again.
Your content
You keep the rights to your recipes, photos and text. By publishing a showcase you give us permission to store, resize and display that content on your showcase and to deliver customer requests to you, for as long as it is published. This permission ends when you remove the content, subject to short delays for backups and caches.
Using the service
Please do not misuse Tortally: no attempts to break or overload the service, scrape private data, send automated requests, or use someone else’s account. We may suspend access to online features if you break these terms. The app’s local features keep working on your phone.
The app, its design and its name belong to us. You may use the app for your own baking business as these terms allow.
Availability and changes
We work to keep the online service running, but we do not promise it will always be available or error-free. We may change features, prices for new purchases, or these terms. If a change matters, we will update the date above and tell you in the app. Price changes for an existing subscription follow the store’s rules and need your approval where the store requires it.
Liability
Tortally is provided “as is.” To the extent the law allows, we are not liable for lost profits, lost data, or indirect damages. For any other claim, our total liability is limited to the amount you paid us through the store in the 12 months before the claim. Nothing in these terms limits any legal rights that cannot be waived, such as consumer rights where you live.
Privacy
How we handle data is described in the Privacy policy.
